Terms of Service

These Terms of Service ("Terms") govern the use of the "5-Minute Novel" app ("Service") provided by the developer ("Operator"). All users must read and agree to these Terms before using the Service.

Article 1 (Definitions)

  1. "Operator" refers to the developer and provider of the Service.
  2. "Registered User" refers to a user who has registered an account using the login features provided by the Service.
  3. "Posted Content" refers to novels, titles, summaries, and other information submitted to the Service by a Registered User.

Article 2 (Account Registration and Management)

  1. Users can register an account using their X (formerly Twitter) account or Apple ID.
  2. Registered Users are responsible for managing their accounts. The Operator assumes no responsibility for any damages caused by unauthorized use of the account.

Article 3 (Services and In-App Purchases)

  1. Basic features (viewing, posting, free likes, following, bookmarks, etc.) are available for free.
  2. Users may purchase paid items (e.g., "Premium Like") to support authors. Payments are processed through the payment system provided by Apple Inc.
  3. Purchased paid items cannot be refunded, returned, or exchanged for any reason. If an account is deleted, purchase history and item effects will not be transferred.

Article 4 (Content and Copyright)

  1. The copyright of the Posted Content belongs to the Registered User who posted it.
  2. The Operator may use (e.g., reproduce, display) the Posted Content free of charge within the scope necessary for providing the Service, system improvement, and promotion.
  3. Users must not post unauthorized reproductions or copies of other people's works.

Article 5 (Prohibited Actions)

Users must not engage in the following actions. If confirmed, the Operator may delete the content or suspend the account without prior notice.

  1. Actions violating laws or public policy.
  2. Posting explicit sexual content, excessive violence, or content constituting child pornography or abuse.
  3. Unjustly discriminating, slandering, or defaming specific individuals, races, beliefs, or genders.
  4. Infringing on third-party copyrights, trademarks, privacy rights, or other rights.
  5. Spamming, multi-level marketing, religious solicitation, or other commercial advertising.
  6. Impersonating other users or third parties.
  7. Placing an excessive burden on the Service's servers or network.
  8. Other actions deemed inappropriate by the Operator.

Article 6 (Content Monitoring and Measures)

  1. The Operator has the right to monitor Posted Content and delete or hide content that violates these Terms without prior notice.
  2. Users can report inappropriate content using the "Report" feature in the app. The Operator will review and take appropriate action.
  3. The Operator may suspend or terminate the accounts of users who violate these Terms without prior notice.

Article 7 (Account Deletion)

  1. Registered Users can delete their accounts at any time from the settings screen within the app.
  2. Upon account deletion, personal information (linked account data) will be completely deleted from the database.
  3. However, Posted Content submitted prior to account deletion will remain on the Service with the author's name changed to "Anonymous". Users must manually delete their works before deleting their accounts if they wish to remove them.

Article 8 (Disclaimer)

  1. The Operator does not guarantee that the Service is free of factual or legal defects (including safety, reliability, accuracy, bugs, or data loss).
  2. The Operator is not liable for any damages (including data loss or communication failures) incurred by the user arising from the use of the Service.
  3. Troubles between users or between users and third parties shall be resolved between the parties involved.

Article 9 (Changes, Suspension, and Termination)

The Operator may change, suspend, or terminate the Service without prior notice. The Operator assumes no liability for any damages caused by such actions.

Article 10 (Changes to Terms)

The Operator may change these Terms at any time without user consent. The modified Terms become effective when posted within the Service or on a designated website.

はじめに
本利用規約（以下「本規約」といいます）は、当アプリ「5分小説」（以下「本サービス」といいます）の利用条件を定めるものです。本サービスをご利用になるすべての方（以下「ユーザー」といいます）は、本規約の全文をお読みいただいた上で、同意していただく必要があります。

第1条（定義）

  1. 「運営者」とは、本サービスの開発・提供者をいいます。
  2. 「登録ユーザー」とは、本サービスの提供するログイン機能を利用し、アカウント登録を行ったユーザーをいいます。
  3. 「投稿コンテンツ」とは、登録ユーザーが本サービスに送信した小説、タイトル、あらすじ等の情報をいいます。

第2条（アカウント登録と管理）

  1. ユーザーは、X（旧Twitter）アカウントまたはApple IDを使用し、所定の方法によりアカウントを登録することができます。
  2. 登録ユーザーは、自己の責任においてアカウントを管理するものとします。アカウントの不正利用により生じた損害について、運営者はいかなる責任も負いません。

第3条（提供サービスと課金機能）

  1. 本サービスの基本的な機能（作品の閲覧・投稿、無料のいいね、フォロー、しおり等）は無料で利用できます。
  2. 本サービスでは、作者を応援するための有料アイテム（「プレミアムいいね」等）を購入することができます。有料アイテムの決済はApple Inc.が提供する決済システムを通じて行われます。
  3. 購入した有料アイテムは、理由の如何を問わず返金・返品・交換することはできません。また、アカウントを削除（退会）した場合、購入履歴やアイテムの効果は引き継がれません。

第4条（投稿コンテンツと著作権）

  1. 投稿コンテンツの著作権は、当該コンテンツを投稿した登録ユーザーに帰属します。
  2. 運営者は、本サービスの円滑な提供、システムの構築・改良、プロモーション等の範囲内において、投稿コンテンツを無償で利用（複製、表示等）できるものとします。
  3. ユーザーは、本サービス以外の他者の作品を無断で転載・複製して投稿してはなりません。

第5条（禁止事項）

ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。これらの行為が確認された場合、運営者は事前の通知なく当該コンテンツの削除やアカウントの停止措置をとります。

  1. 法令、公序良俗に反する行為。
  2. 露骨な性的表現、過度な暴力表現、児童ポルノまたは児童虐待に相当する表現を含むコンテンツを投稿する行為。
  3. 特定の個人、人種、信条、性別等を不当に差別・誹謗中傷し、名誉や信用を毀損する行為。
  4. 第三者の著作権、商標権、プライバシー権、肖像権その他の権利を侵害する行為。
  5. スパム行為、マルチ商法、宗教の勧誘、その他営利を目的とする宣伝・広告行為。
  6. 他のユーザーまたは第三者になりすます行為。
  7. 本サービスのサーバーやネットワークに過度な負担をかける行為。
  8. その他、運営者が不適切と判断する行為。

第6条（コンテンツの監視と措置）

  1. 運営者は、本サービスが安全に利用されるよう投稿コンテンツを監視し、本規約に違反する、または不適切と判断したコンテンツを予告なく削除・非公開にする権利を有します。
  2. ユーザーは、本サービス内の「通報機能」を利用して、本規約に違反すると思われるコンテンツを運営者に報告することができます。運営者は報告内容を確認し、迅速かつ適切に対処します。
  3. 本規約に違反したユーザーに対し、運営者は事前の通知なくアカウントの利用停止、または強制退会の措置をとることができます。

第7条（退会とデータ消去）

  1. 登録ユーザーは、本サービス内の設定画面から所定の手続きを行うことで、いつでも退会（アカウントの削除）をすることができます。
  2. 退会に伴い、ユーザーの個人情報（連携したアカウント情報等）はデータベースから完全に削除されます。
  3. ただし、退会前に投稿された作品データについては、作者名が「名無し」に変更された状態で本サービス上に残り続けます。作品自体の削除を希望する場合は、ユーザー自身で退会手続きの前に作品を削除する必要があります。

第8条（免責事項）

  1. 運営者は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、バグ、データ消失等）がないことを明示的にも黙示的にも保証しません。
  2. 運営者は、本サービスの利用に起因してユーザーに生じたあらゆる損害（データの消失、通信障害等を含む）について、一切の責任を負いません。
  3. ユーザー間、またはユーザーと第三者との間で生じたトラブル（著作権侵害、誹謗中傷等）については、当事者間で解決するものとし、運営者は一切の責任を負いません。

第9条（サービスの変更・中断・終了）

運営者は、必要と判断した場合、ユーザーに事前の通知をすることなく、本サービスの内容を変更、または提供を中断・終了することができます。これにより生じた損害について、運営者は一切責任を負いません。

第10条（規約の変更）

運営者は、必要と判断した場合には、ユーザーの承諾を得ることなくいつでも本規約を変更することができるものとします。変更後の規約は、本サービス内または所定のウェブサイトに掲示された時点で効力を生じるものとし、ユーザーはこれに同意したものとみなします。
